8.5.3 Effective Date of CancellationCancellation will take effect at the end of your current billing cycle, except as noted in the Cancellation Window Restrictions below.
8.5.4 Cancellation Window RestrictionsCancellations will not be accepted between the signup deadline (around the 22nd of the month) and the end of Wave 3 of the Pair Drop (around the 30th of the month). If you wish to cancel your subscription, please do so outside of this period.
8.5.5 Late CancellationIf you attempt to cancel after your billing cycle has begun, you will have the option to participate in the upcoming Pair Drop event. If you choose not to participate, your payment will still be non-refundable for that billing cycle.
8.5.6 No RefundsAll payments are non-refundable, and no refunds or credits will be provided for partial subscription periods, regardless of your participation in the Pair Drop or cancellation timing, except as expressly provided below.
8.5.7 Exception for Prior Cancellation AttemptsIf you attempted to cancel your subscription before the introduction of our online cancellation system, please send us an email at support@inpairs.io. Upon verifying the details, we will issue a refund.

Activation/Deactivation: Enable or disable the feature in your account settings.
Designating a Wali: You can appoint a Wali to act on your behalf during the initial stages of communication.
Contact Information Sharing: Upon matching, the Wali's contact information may be shared instead of yours.
Communication Role: Your Wali helps facilitate introductions and ensures culturally aligned interactions.
While your Wali can view your profile, they must respect your privacy, and you are responsible for ensuring that they understand and agree to our Terms and Privacy Policy.
10.6 Profile Visibility and Sharing with MatchesYour profile information, including photos and biographical details, is used to facilitate compatible matches based on the preferences and criteria you have provided.When matched, users may see each other's profiles, including photos and biographical details, according to your privacy settings. Your wali may also have access to view your profile.Your profile details are not publicly visible. Only matched users can view your information.Your contact information remains private until you and your match mutually agree to share it. We prioritize privacy and ensure contact details are exchanged only with explicit consent.You control who sees your profile through your privacy settings, which can be adjusted anytime.
10.7 Accuracy and Responsibility for ContentYou agree to provide accurate, up-to-date information in your profile and communications. You are responsible for promptly updating your information to ensure its accuracy.You are solely responsible for any User Content you submit, upload, publish, or display on or through the Service.
10.8 Content Moderation and RemovalInPairs reserves the right to monitor, review, and remove any User Content that violates these Terms, Community Standards, or applicable laws. Automated systems and human moderators may be used for content review.Content violating policies may be edited or removed without prior notice, and repeated violations may result in warnings, feature restrictions, or account suspension or termination.We may notify you of content removal or account actions and provide information on how to appeal.
10.9 Intellectual Property RightsYou represent and warrant that you own or have the necessary rights and permissions to use and license the User Content you submit. Limitations of LiabilityInPairs is not responsible for the data handling practices of Masajid Partners beyond the obligations outlined in these Terms and our agreements with them.
11.5 Opt-Out of Data SharingIf you wish to opt out of sharing your data with Masajid Partners, you may adjust your privacy settings in your account. Please note that opting out may limit certain features of the Service, including community-based matchmaking and verification badges.
12. Masajid Partners' Role and Responsibilities
12.1 Access to User DataMasajid Partners have limited access to user data as necessary for:
Matchmaking Services: Accessing user profiles and match data across multiple Masajid to facilitate community-based matchmaking.
Verification Purposes: Viewing user photographs and profiles to provide badge verification, confirming your involvement or affiliation with a Masjid Partner.
12.2 User ModerationMasajid Partners may be involved in moderating user activity to maintain the integrity and safety of the Service. Their responsibilities include:
Account Termination: Masajid Partners have the authority to suspend or terminate user accounts where necessary, in accordance with these Terms. Reasons may include violations of Community Standards, inappropriate behavior, or misrepresentation.
Content Review: Reviewing User Content for compliance with Community Standards and reporting any violations to InPairs for further action.
12.3 Marketing and Community EngagementMasajid Partners may engage in activities to promote the Service and foster community engagement:
Marketing Activities: Promoting InPairs within their communities through events, announcements, or other outreach efforts.
Community Events: Using user data (with explicit consent) to invite users to community events, workshops, or programs that may benefit them.
Any logos, trademarks, service marks, branding materials, or other content provided by Masajid Partners are protected under intellectual property laws.
This includes any materials made available to users through the InPairs platform.
User Obligations
No Unauthorized Use: You agree not to use, reproduce, modify, distribute, display, or create derivative works from any Masajid Partners' intellectual property without explicit written permission from the respective Masjid Partner.
Consequences of Unauthorized Use: Unauthorized use of Masajid Partners' intellectual property may result in:
Immediate termination of your InPairs account.
Legal action taken by the Masjid Partner or InPairs.
Respect for Rights: You acknowledge and agree to respect the intellectual property rights of Masajid Partners as well as those of InPairs and other third parties.

Prioritizes Safety and Privacy: Users must respect the privacy of others and are encouraged to follow personal safety guidelines when interacting both on and off the platform.
13.2 Acceptable BehaviorAs an InPairs user, you are expected to:
Engage Respectfully: Treat other users with kindness, respect, and empathy. Avoid language or behavior that could be interpreted as hostile, aggressive, or offensive.
Maintain Authenticity: Ensure that the information you provide in your profile is honest and complete. Misrepresentation of your identity, intent, or personal details undermines the community’s trust.
Communicate Appropriately: Use language that aligns with Islamic etiquette. Conversations should reflect the purpose of the platform and avoid discussions that may be inappropriate, offensive, or contrary to Islamic values.
Report Issues Thoughtfully: InPairs encourages users to report violations of our standards. Any report should be made with a clear intention to help improve the community, without malicious intent or misuse.
13.3 Prohibited Activities and ContentTo protect our users and maintain the integrity of InPairs, certain behaviors and content are strictly prohibited. Violating these rules may result in content removal, account suspension, or permanent banning.
Harassment, Bullying, and Intimidation: Engaging in harassment, coercive language, or bullying is strictly forbidden. This includes repeated unsolicited messages, attempts to contact users after being declined, or any behavior that may cause distress.
Offensive, Defamatory, or Inappropriate Content: InPairs prohibits content that is obscene, defamatory, sexually explicit, discriminatory, or otherwise offensive. This includes language or images that depict or endorse violence, hate speech, or discrimination based on religion, race, gender, or ethnicity.
Dishonesty and Misrepresentation: Creating an account under false pretenses, using another person’s identity, or sharing misleading information about your age, marital status, or background is prohibited.

Content Removal: Inappropriate photos, profile descriptions, or other User Content will be removed.
Warnings or Restrictions: You may receive warnings or feature limitations.
Account Suspension or Termination: Severe or repeated violations, particularly those involving harassment, abuse, or dangerous behavior, will result in a permanent ban. Suspended users are not eligible for refunds of any fees paid for subscriptions.

16. Withdrawal of InPairs Services
InPairs reserves the right to discontinue all or part of its services at any time.

17. Our Rights in InPairs
17.1 Intellectual Property Ownership
InPairs Inc owns or holds licenses for all intellectual property rights related to the InPairs platform and all content published on it, including but not limited to logos, trademarks, software, text, graphics, and design elements.
These materials are protected by copyright, trademark, and other intellectual property laws. All rights are reserved, and no part of InPairs may be used outside the scope of these Terms without our explicit permission.
17.2 InPairs Trademarks
The InPairs name, logo, and related trademarks are the exclusive property of InPairs Inc. These marks may not be used without our prior written approval.
You are not permitted to use the InPairs trademarks or logos for commercial purposes or in any manner that could imply endorsement by InPairs unless expressly authorized by us.
17.3 Limited License for Personal Use
We grant you a limited, non-exclusive, non-transferable, revocable license to view, download, and use InPairs content solely for your personal, non-commercial use.
This license does not allow for redistribution, commercial use, or modification of any InPairs materials or content, except as permitted in these Terms.
Your use of the InPairs Service does not grant you any rights, title, or interest in or to any intellectual property rights owned by Masajid Partners, InPairs, or any other party.
17.4 Restrictions on Use
You may not modify, copy, distribute, or create derivative works from any content or materials on InPairs without express written permission from us.
Unauthorized use of any illustrations, photographs, video or audio sequences, graphics, or text independently of the original context is prohibited.
17.5 Breach of Intellectual Property Rights
If you misuse InPairs content or materials in violation of these Terms, your right to access and use InPairs will cease immediately.
We reserve the right to take legal action to protect our intellectual property, and you may be required to return or destroy any copies of materials you have improperly used.
18. Suspension of Access to InPairs and Service Features
18.1 Service Suspension
We may need to temporarily suspend access to InPairs or specific features of the Service for reasons including:
Technical maintenance;
Regulatory compliance;
Service updates.
18.2 Notification of Suspension
Where possible, we will inform you in advance if a temporary suspension is planned.
In urgent or emergency cases, we may suspend the Service without prior notice but will work to restore access as quickly as possible.
19. Our Responsibility to You
19.1 Standard of Service
InPairs is dedicated to providing high-quality matchmaking features and functionality.
We take reasonable care to ensure that the Service meets your expectations and is free from technical issues. We are also actively building the service and anticipate there will be bugs. Our goal is to resolve all bugs swiftly to ensure continuity of service.
19.2 User Responsibility for Compliance
We ask users to follow these Terms, including all guidelines related to safe and respectful use of InPairs.
Users bear responsibility for any consequences that may arise from non-compliance with these Terms.
19.3 No Responsibility for User Interactions and Optional Background Checks
InPairs facilitates connections between users but is not responsible for the conduct of individual members.
We do not perform background checks or verify the authenticity of personal information provided by users unless a user pays for such a service. As part of this agreement, users consent to have a background check conducted by a third-party service.
Optional Background Checks:
User-Initiated Checks: We may offer users the option to request background checks on themselves or other users for a fee.
Third-Party Services: Any background checks conducted are performed by third-party service providers, and InPairs does not guarantee the accuracy or completeness of the information obtained.
Compliance with Laws: Users must comply with all applicable laws and regulations regarding the request and use of background check information.
Information Use: Background check information is provided for personal use only and must not be shared, published, or used for unlawful purposes.
20. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW:
Under no circumstances and under no legal theory (including, without limitation, contract, tort, strict liability, or otherwise) shall InPairs or its affiliates, partners, licensors, suppliers, service providers, Masajid Partners, and others be liable to you for:
(A) Any indirect, reliance, special, exemplary, incidental, punitive, or consequential damages, including, without limitation, damages for lost profits, loss of goodwill, business interruption, or other issues.
(B) Any amount exceeding the greater of $100 or the total amount you have paid to InPairs for the service during the prior 12 months.
(C) Any matter beyond InPairs’ reasonable control.
The foregoing limitations shall apply regardless of the legal theory under which liability is asserted.
Exception: The above limitations do not apply in cases of gross negligence or willful misconduct caused directly by InPairs or the Masajid Partners.
Time Limit to Bring Claims: Any claim must be filed within one (1) year of the cause of action or be forever barred.
Some jurisdictions do not allow exclusions of certain damages, so these limitations may not apply to you.

21.1 User Feedback and Suggestions
InPairs values feedback, ideas, and suggestions from users ("Feedback") to help improve our Service.

InPairs takes reasonable measures to keep our platform secure and free from viruses, malware, and other harmful digital threats. Despite these precautions, we cannot guarantee that InPairs will always be completely free of such risks.
24.2 User Responsibility for Device Security
It is your responsibility to maintain up-to-date antivirus and security software on your devices when accessing InPairs.
24.3 InPairs' Liability
InPairs will not be responsible for any damage to devices, software, or data resulting from viruses or harmful software encountered through our platform.

If your account is terminated due to a breach, no refund will be issued for unused subscription portions.

In addition to misuse, we may close accounts for business reasons, including changes in operational capacity or legal requirements, with notice via email.

InPairs and its affiliates are not responsible for loss or damage arising from user content, service interruptions, user conduct, technical issues, or network failures.
InPairs provides the Service "AS IS" and makes no warranties regarding uninterrupted or error-free service.
You assume all risks related to downloading material from the Service, including potential damage to your device or data loss.
Third-Party Content
InPairs does not guarantee the accuracy or reliability of third-party content provided through the Service.
InPairs and its partners are not liable for any loss or damage resulting from reliance on third-party content.

28. Indemnification
28.1 User Indemnification
You agree to indemnify, defend, and hold harmless InPairs, its affiliates, officers, directors, employees, agents, and Masajid Partners from any claims, liabilities, damages, losses, and expenses arising from:
Your use of the Service, including third-party actions taken using your account.
Your violation of these Terms, applicable laws, or regulations.
User content you post, upload, or transmit.
Your violation of rights, including intellectual property or privacy rights.
This indemnification does not apply if the claim arises directly from Masajid Partners' significant negligence or willful misconduct.
28.2 Defense and Control
InPairs reserves the right to assume the exclusive defense and control of any indemnifiable matter at its own expense, and you agree to cooperate in asserting defenses.
29. Dispute Resolution and Arbitration Agreement
Please read the following ARBITRATION AGREEMENT carefully as it requires you to arbitrate certain disputes and claims with InPairs and limits the manner in which you can seek relief from InPairs. Both you and InPairs acknowledge and agree that InPairs' officers, directors, employees, agents, Masjid Partners, and independent contractors ("Personnel") are third-party beneficiaries of these Terms of Service. Upon your acceptance of these Terms, Personnel will have the right to enforce this Terms against you as third-party beneficiaries hereof.
29.1 Informal Resolution
If a dispute arises, we encourage you to contact us directly to seek an informal resolution at support@inpairs.io.
Both parties should use their best efforts to settle any dispute within 60 days of the dispute being notified.
This informal resolution is a precondition for initiating arbitration.
29.2 Binding Arbitration
If the dispute is not resolved informally, you and InPairs agree to resolve the dispute through binding arbitration, as governed by the Federal Arbitration Act.
29.2.1 Arbitration Rules
The arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

29.2.2 Arbitration Location and Procedure
Unless otherwise agreed, arbitration will take place in Delaware, or another mutually agreed location.
If the claim is under $10,000, the arbitration will be based solely on documents unless a hearing is requested or deemed necessary.
29.2.3 Arbitrator's Authority
The arbitrator has the authority to resolve disputes regarding the arbitration agreement's applicability and enforceability.
29.2.4 Costs of Arbitration
InPairs will cover all arbitration fees for claims under $75,000 unless the arbitrator deems the claims frivolous.
29.2.5 Confidentiality
All arbitration proceedings will remain confidential unless required by law.
29.3 Waiver of Jury Trial
You waive your rights to a court trial and a jury trial. Disputes will be resolved through arbitration procedures instead, which are more limited, efficient, and cost-effective.
29.4 Waiver of Class or Consolidated Actions
Claims must be arbitrated individually and cannot be combined with those of other users.
If this waiver is deemed unenforceable, all disputes will be resolved in court, not through arbitration.
29.5 Opt-Out Procedure
You have 30 days to opt out of this arbitration agreement by notifying InPairs in writing. The notice must include your full name, email/phone, and a statement of your opt-out choice.

29.6 Exceptions to Arbitration
Disputes eligible for small claims court or seeking injunctive relief for intellectual property violations are exempt from arbitration.
29.7 Exclusive Venue
If arbitration is not opted out or if litigation occurs, the dispute will be resolved in courts in Delaware, unless required otherwise by your local laws.
29.8 Severability
If any part of this arbitration agreement is unenforceable, the rest will remain valid, except if the class action waiver is found unenforceable.
29.9 Survival
This arbitration agreement survives the termination of your relationship with InPairs.
29.10 Governing Law
The arbitration agreement is governed by the Federal Arbitration Act, with Delaware law applying to matters not covered by federal law.
